Executive Summary: New Limits on Compensation Paid to Executives of State Service Providers

Introduction

On January 18, 2012,New York Governor Andrew Cuomo (D) signed Executive Order No. 38, “Limits on State-Funded Administrative Costs & Executive Compensation”(Executive Order). Under its terms, New York will not reimburse a provider of services to New York state1 for the compensation of an executive of the provider that exceeds$199,000 and also will not reimburse the provider for administrative costs that exceed 25% of the amounts otherwise payable to the provider by the state.2
